Europa IPTV complies with Spanish laws and regulations

Europa Network has been in business for 9 years providing telephone services to the English community based in Spain. Our solution is totally legal for the following reasons:

  1. We have all the necessary licences from the CMT (Comisión del Mercado de las Telecomunicaciones) to stream IPTV content within Spain and the Islands. This can be seen here XXX.
  2. We have been working with our lawyers Garrigues to comply with the conditions of delivering Free to Air (FTA) content from the UK, whilst complying with all Spanish laws. Garrigues is one of the top European legal services firms, both in terms of billings and number of fee earners. The Firm, which provides comprehensive advisory services, has the largest network of offices in Spain, as well as dedicated offices in London, New York, Brussels, Lisbon, Oporto, Bucharest, Warsaw, Casablanca, Tangiers and Shanghai. They also have one of the best practises in Spain regarding the development of IPTV and have been awarded the following awards:
    1. Garrigues, ‘Spanish Law Firm of the Year’ - Chambers Europe Awards for Excellence - 2009
    2. Garrigues singled out as the ‘2008 Firm of the Year’ by the UK publication TopLegal International - 2009
    3. Garrigues makes the Global Project Finance Top Ten 2009
    4. Garrigues won Best European Independent Law Firm of the Year Award 2008
    5. Garrigues rated a top-tier firm in eight practice areas according to Legal 500 - 2008
  3. We do not charge clients anything for our IPTV platform — absolutely nothing. You cannot charge for something that you haven’t purchased or own. As long as you have 3MB ADSL you can use our IPTV platform, no conditions. For example if you have a Set Top Box working and install it at another Europa customer’s address, it will work. If you don’t want to buy a Set Top Box you can use the service via our client software straight away — no charge, no small print, no monthly maintenance charge or membership. We will monetarise this platform by winning more customers for all out other telecommunication services.
  4. We do not encrypt content that is delivered un-encrypted.
  5. We will not un-encrypt content that has been delivered encrypted. For example no SKY content will be available.
  6. We do not change or “alter” the content or add advertising. The content is delivered exactly as it is in the UK.
  7. We have pre-emptively agreed to pay copyright fees to the two relevant organisations in Spain, one for audio content and the other for visual content - SGAE and EGEDA.
  8. Television without Frontiers Directive (TVFD) becomes AVMS. The new Audiovisual Media Services Directive which also covers on-demand services must be applied by EU governments by 19 December 2009 at the latest. This law fully supports our business model.
  9. Free to Air UK content, such as BBC and ITV are transmitted with no encryption for UK viewers and we deliver this content to our customers with exactly the same conditions. The content providers may not agree with our solution although it is technically and legally acceptable (in Spain). They might not like you watching their channels outside the UK, but there is little they can do about it.
